A man convicted of burglarizing a Dunkirk man’s garage is suing the homeowner who shot him as he ran away. David Bailey’s lawsuit comes after the homeowner, David McLaughlin, was found guilty of criminal recklessness in the shooting and was sentenced to 60 days in jail. Bailey was shot in the arm as he ran from the scene and pleaded guilty to the burglary, though in his civil lawsuit he contends he never entered the garage for the purpose of stealing property. He’s asking the judge for a settlement that would sufficiently compensate him for his wound.
